標(biāo)準(zhǔn)服務(wù)條款(2021版)
● Explain解釋
1.1 The “Lead Time” promised in this quotation means the lead time for initial testing. And it is based on the effective cooperation of the person or body who requests services (called as the “Principal” hereinafter) and the fulfillment of all the following items. Otherwise, China Certification ICT Co., Ltd (Dongguan) (called as “the CCICT” hereinafter) is not subject to the restriction of “Lead Time”.
本報(bào)價(jià)承諾的“測(cè)試時(shí)間”指的是完成首次測(cè)試所需要的時(shí)間。該時(shí)間建立于要求服務(wù)的自然人或法人（以下稱“委托方”）的有效配合，并在滿足下列條款的基礎(chǔ)上，否則東莞中認(rèn)信通檢測(cè)技術(shù)有限公司（以下稱“CCICT”）不受“測(cè)試時(shí)間”的約束。
The “Lead Time” would be counted after our lab receiving your samples, relevant information and down payment. The time will be put off if there was fail exit. The “Lead Time” is counted by working day.
測(cè)試時(shí)間以CCICT收到委托方的測(cè)試樣品，相關(guān)資料及預(yù)付款起計(jì)；若有任何缺失，時(shí)間順延，所有測(cè)試時(shí)間以工作日計(jì)。
1.2 The "Testing and Test" would be include Testing, Certification, Calibration, and Inspection. Testing Location include CCICT Lab. principal on-site authorized test lab, subcontracting part(s) of the testing to other recognized laboratories, principal testing location.
“測(cè)試”的定義包含了檢測(cè)、現(xiàn)場(chǎng)目擊檢測(cè)、認(rèn)證、校準(zhǔn)、檢查。測(cè)試地點(diǎn)包含CCICT實(shí)驗(yàn)室、委托方的授權(quán)實(shí)驗(yàn)室、轉(zhuǎn)包的其他認(rèn)可試驗(yàn)室和委托方測(cè)試現(xiàn)場(chǎng)。
1.3 The "Sample" would be include testing object, calibration object, certification object, inspection object and organization.
“樣品”的定義包含了檢測(cè)對(duì)象、校準(zhǔn)對(duì)象、認(rèn)證對(duì)象、檢查對(duì)象和組織。
1.4 The above charges do not include any fee for retesting and modification.
上述估價(jià)不包括任何可能需要的復(fù)檢、整改的費(fèi)用。
1.5 This quotation is based on submitted information from the Principal. The Company reserves the right to adjust the charge and schedule if further testing is found to be necessary on receipt of full samples and documents.
該報(bào)價(jià)單是基于委托方所提供的信息而報(bào)出的。如果收到完整的樣品及文件后發(fā)現(xiàn)必須增加更多的測(cè)試時(shí)，CCICT保留調(diào)整收費(fèi)及時(shí)間表的權(quán)力。
1.6 The Company reserves the right of subcontracting part(s) of the testing to other recognized laboratories，at the same time, CCICT reserves the right to adjust charge and schedules due to subcontracting.
CCICT保留將部分測(cè)試轉(zhuǎn)包給其他認(rèn)可試驗(yàn)室的權(quán)利，同時(shí)CCICT保留因轉(zhuǎn)包引起的調(diào)整收費(fèi)及時(shí)間表的權(quán)力。
1.7 If apply for model revision, alternative component or co-license, basing on the previous certificate or report, the standard number and standard version are the same of the ones on the previous certificate or report. Ifrequired update the standard of report and certificate, CCICT reserves the right to adjust charge and schedules.
如果基于之前的證書(shū)或報(bào)告的基礎(chǔ)上申請(qǐng)任何型號(hào)報(bào)備、零部件報(bào)備或子證，標(biāo)準(zhǔn)號(hào)和標(biāo)準(zhǔn)版本號(hào)均以原證書(shū)或報(bào)告為準(zhǔn)。如需升級(jí)標(biāo)準(zhǔn)，CCICT保留調(diào)整收費(fèi)和時(shí)間表的權(quán)力。
1.8 If other CCICT office has also quoted for this project, the highest prices of quotation among CCICT offices will be the final charge of this quotation.
如果CCICT其他分公司也對(duì)該項(xiàng)目報(bào)價(jià)的話，我們會(huì)以所有報(bào)價(jià)中的最高價(jià)格作為該報(bào)價(jià)的最終價(jià)格。
● Declaration 聲明
2.1 Test results express the opinion on the presented samples only, but do not express any opinion upon the bulk from which the samples were drawn.
測(cè)試結(jié)果僅對(duì)所測(cè)試的樣品負(fù)責(zé)，并不適用于整批貨物。
2.2 Test result contains the test items which the applicants applied for and the relevant test results. If the applicant want to inform CCICT about the error or omit maybe exist in test report, you must put forward by written format and describe your requirements and the question needed explanation in 15 workdays after you received the test report. If the applicant does not put forward query in the provision deadline, that means you have already confirmed the accuracy and completeness of the test report issued by CCICT.
CCICT.測(cè)試報(bào)告內(nèi)容為申請(qǐng)人所申請(qǐng)的測(cè)試項(xiàng)目及相關(guān)的測(cè)試結(jié)果。若申請(qǐng)人要告知CCICT關(guān)于測(cè)試報(bào)告中可能存在的錯(cuò)誤或遺漏，必須要收到測(cè)試報(bào)告起15個(gè)工作天內(nèi)以書(shū)面的形式提出并寫(xiě)明要求及需要說(shuō)明的問(wèn)題。申請(qǐng)人在上述規(guī)定時(shí)間內(nèi)沒(méi)有提出疑問(wèn)，即表示其確認(rèn)CCICT出具的測(cè)試報(bào)告正確和完整。
2.3 If the test report issued by CCICT will be used for litigation or arbitration, the applicant must submit written notification at the same time submission of the application form.
若申請(qǐng)人要將CCICT出具的測(cè)試報(bào)告用于訴訟或仲裁，則必須在提交申請(qǐng)表時(shí)書(shū)面告知。
2.4 If the test result has error and confirmed the error caused by CCICT or its agent, or if there is a fundamental breach of contract caused by CCICT, CCICT only limit to undertake the interest-free expenses of client application test, and not to be responsible to compensate for the loss or damage of the applicant or third party due to the test report error.
若測(cè)試結(jié)果存在差錯(cuò)且證實(shí)系由CCICT或其代理商所造成，或由CCICT造成的根本違約，CCICT只限于承擔(dān)客戶申請(qǐng)測(cè)試的無(wú)息費(fèi)用的賠償責(zé)任，而不負(fù)責(zé)賠償由于測(cè)試報(bào)告的差錯(cuò)而引起的申請(qǐng)人或第三方的任何損失或損害。
2.5 The sample may be broken during the testing; CCICT does not assume any responsibility for the damage，the sample maximum retention time is 30days after test report issued or got the certificate, If overdue, we will scrap the test sample automatically, If you need the entire test sample to be returned, please inform us in advance by contract and follow the principle of sample return strictly, If the Express Company has caused damage to the sample, CCICT can assist the client to Claim to Express Company, but CCICT shall bear no compensation liabilities, CCICT does not assume any liability for compensation for the loss or damage of third party due to during the testing client’s sample design defects, functional defects, and performance defects of the client's samples that lead to damage or loss of the samples, as well as injuries and losses to the client or third parties.
因測(cè)試過(guò)程中可能對(duì)樣品造成損壞，CCICT不承擔(dān)任何樣品損壞的責(zé)任，樣品最長(zhǎng)保留時(shí)間為報(bào)告核發(fā)后或取得相關(guān)證書(shū)后30天，過(guò)期我們自動(dòng)會(huì)報(bào)廢，如果需要退回的請(qǐng)?zhí)崆昂贤s定并嚴(yán)格遵循我司退樣原則；如果是因?yàn)榭爝f公司造成委托方樣品損壞的，CCICT可協(xié)助委托方索賠，但不承擔(dān)賠償責(zé)任，因?yàn)槲蟹降臉悠吩跍y(cè)試過(guò)程中因樣品自身設(shè)計(jì)缺陷、功能缺陷、性能缺陷導(dǎo)致樣品損毀、丟失及造成委托方或第三方傷害和損失，CCICT不承任何賠償責(zé)任及第三方損害責(zé)任。
2.6 Based on accreditation rules, product certification rules, and legal and regulatory requirements, customers assume that CCICT can directly provide relevant information to accreditation agencies, certification agencies, or statutory regulatory agencies without prior approval.and free from relevant confidentiality obligations.。基于認(rèn)可規(guī)則、產(chǎn)品認(rèn)證規(guī)則和法律法規(guī)要求，客戶默認(rèn)CCICT可以直接向認(rèn)可機(jī)構(gòu)，認(rèn)證機(jī)構(gòu)或法定監(jiān)管機(jī)構(gòu)提供的相關(guān)信息而不需要事先得到批準(zhǔn)，也不受相關(guān)保密條款約束。
2.7 In no event will CCICT be liable for any special, incidental, consequential, indirect or similar damages, including loss of profits, lost savings, loss of data, or any other damages arising out of the use of or the inability to use these services, even if CCICT or an authorized CCICT representative has been advised of the possibility of such damage. In no event shall CCICT’s liability for any damages regardless of the form of the claim.
CCICT不會(huì)對(duì)任何由于使用產(chǎn)品功能所引起的特殊的、偶然的、由其引發(fā)的、非直接的事件造成的任何損害，或者是類似的任何損害包括利潤(rùn)損失、存款損失、數(shù)據(jù)丟失等損害和失效負(fù)責(zé)任。即使這些損害的可能性曾經(jīng)通知過(guò)CCICT或者CCICT的授權(quán)代表。
2.8 Any information, samples or other related documents (including without limitation certificates and reports) provided by the Client to CCICT will not, in any circumstances, infringe any legal rights (including Intellectual Property Rights) of any third party.
無(wú)論在任何情況下，由客戶向CCICT提供的任何信息、樣品或其他相關(guān)文件（包括但不限于證書(shū)和報(bào)告）均不得在任何情形下侵犯任何第三方的任何合法權(quán)利（包括知識(shí)產(chǎn)權(quán)）。
2.9 The client shall notify the CCICT in advance in writing of actual or potential hazards or dangers related to the sample, including but not limited to radiation, toxic and harmful, flammable and explosive components, materials or components. All losses (including but not limited to investigation fee, medical fee, litigation fee, lawyer's fee, etc.) due to the failure of the principal to perform the above notification obligation are compensated by the principal. When necessary, the client shall provide the necessary technical information and other necessary information.
委托方應(yīng)提前書(shū)面通知CCICT與樣品有關(guān)的、實(shí)際上或潛在的危害或危險(xiǎn)，包括但不限于存在輻射、有毒有害、易燃易爆的成分、材料或部件。由于委托方?jīng)]有履行以上通知義務(wù)所造成的CCICT的一切損失（包括但不限于調(diào)查費(fèi)、醫(yī)療費(fèi)、訴訟費(fèi)、律師費(fèi)等）由委托方予以賠償。需要時(shí)，委托方應(yīng)提供有關(guān)的技術(shù)資料，使用說(shuō)明等必要資料。
● Special Clarity for Tax and other Fees 稅費(fèi)和其他收費(fèi)說(shuō)明
3.1 6% tax fee is required for RMB payment.
人民幣付款須額外支付6%稅費(fèi)。
3.2 If there is the first time for the applicant to apply grant code under FCC ID, Surcharge for Grantee Code is required (Only for EMC Service.)
若是首次申請(qǐng)F(tuán)CC ID Grant code，需額外支付公司代碼費(fèi)。僅限于EMC服務(wù)。
3.3 For FCC ID case, if the clients choose confidential service, extra fee will be charged for every case. (Only for EMC Service.)
對(duì)于FCC ID案件，若客戶申請(qǐng)保密協(xié)議，每個(gè)案件需要額外追加保密費(fèi)。僅限于EMC服務(wù)。
3.4 If there is the first time for the applicant to apply the RPC code under FCC Part 68, Surcharge for RPC is required. (Only for EMC Service.)
若是首次申請(qǐng)F(tuán)CC Part 68，需額外支付公司代碼費(fèi)。僅限于EMC服務(wù)。
3.5 For USA NRTL and Canada SCC Safety Certification case, company ID fee 1000USD /each year, and required factory inspection fee 400USD/time.
對(duì)于USA NRTL and Canada SCC Safety Certification 案件，需要支付每年1000USD檔案年金，工廠檢查費(fèi)用每次400USD。
3.6 If report and sample’s postage cost is incurred, that is for account of clients.
報(bào)告及樣品郵寄費(fèi)用由客戶承擔(dān)。
3.7 If the client request to revise report, Extra pay for modification is required, RMB500 for every report in each time.
若客戶提出報(bào)告修改申請(qǐng)，需要額外支付修改費(fèi)用，每次每份報(bào)告RMB500。
3.8 In order to protect the environment, all the test report will be electronic format. And there is a minimum charge of RMB200 for every paper report per client’s request。
基于保護(hù)環(huán)境需要，我方提供的報(bào)告和證書(shū)均為電子版本的。若客戶要求提供紙質(zhì)報(bào)告，每份報(bào)告需要額外支付RMB 200。
● SAMPLE AND DOCUMENTS 樣品和資料
You are supposed to provide the samples and documents by fax and / or email as listed below, all the documents should be in English.
請(qǐng)將樣品寄至我司實(shí)驗(yàn)室，并按以下要求提供資料（文字資料應(yīng)翻譯成英文）。
4.1 The Principal should submit the clear and integrated application form with signature and company chop (the format of application form will be provided by CCICT).
委托方須提交清晰和內(nèi)容完整且簽名和加蓋公司印章的申請(qǐng)表（申請(qǐng)表格式由CCICT提供）。
4.2 The principal should submit the sample(s) as required on the first page of this quotation before testing.
委托方須在測(cè)試開(kāi)始之前根據(jù)該報(bào)價(jià)單首頁(yè)的要求提交樣板。
4.3 Necessary testing samples. Please indicate the model No. on a sample delivery notice, and paste it onto the package of the testing samples.
必需的測(cè)試樣板。請(qǐng)?jiān)谒蜆忧鍐紊狭忻餍吞?hào)、數(shù)量及報(bào)價(jià)單號(hào)，并把該清單貼在測(cè)試樣板的包裝箱上。
4.4 The principal should submit the necessary technical documents in time according to the check list provided by our assistant after formal application, documents and samples should include this but not limited to.
在正式開(kāi)案申請(qǐng)、文件和樣品提交后，委托方必須依據(jù)我司助理提供的check list及時(shí)提供必要的技術(shù)文件，但不限于以上。
● PAYMENT付款
5.1 Please be advised that the down payment is non-refundable, if the project is terminated due to the clients, the test and report fee must be charged as it occurred.
如因客戶方原因?qū)е马?xiàng)目中止，則項(xiàng)目開(kāi)始前支付的預(yù)付款不予退還，并且實(shí)際發(fā)生的測(cè)試和報(bào)告費(fèi)用必須結(jié)清。
5.2 The Principal is required to pay bank handing charge for remittance.
委托方需要負(fù)責(zé)支付付款銀行手續(xù)費(fèi)。
5.3 CCICT will release the formal test report and certificate with electronic format in 3 days after received the fund. If client can not pay the fund in time according to the provision, CCICT has right to ask client to pay the penal sum of 0.05 percent per delayed workday, penal sum calculate based on the unpaid money.
CCICT收到款項(xiàng)后三日內(nèi)發(fā)放電子版的正式報(bào)告及證書(shū)。如果委托方不能按照規(guī)定及時(shí)支付款項(xiàng)的話，每拖延一個(gè)日歷日，CCICT有權(quán)要求委托人按拖延金額支付每工作日0.05%的違約金。
5.4 Normally the Applicant will be defaulted as the payer, and the bill to party in Final Invoice will be as the Applicant.
通常本公司默認(rèn)申請(qǐng)公司為付款人, 且服務(wù)費(fèi)的發(fā)票所開(kāi)具的抬頭顯示為申請(qǐng)公司。
5.5 If the Principal appoints other company or individual to pay, the Principal should provide the Company a written confirmation about the payer’s payment agreement. If the Company fails to claim the payment from the payer, the Principal still should undertake the obligations of the payment.
如委托方指定其他公司或個(gè)人付款的，需向本公司提供付款人同意付款的書(shū)面證明。本公司向該付款人主張款項(xiàng)未果的，委托方仍需承擔(dān)付款義務(wù)。
5.6 This quotation has been signed by both parties and the certification body has opened a case. If the Principal cancels the entrustment for any reason, the Principal agrees to pay the full amount of fees paid by CCICT. After the Principal signs this quotation and CCICT has completed the pre-test, if the Principal cancels the entrustment for any reason, the Principal agrees to pay the full test fee to CCICT.
本報(bào)價(jià)單自雙方簽訂生效之后且認(rèn)證機(jī)構(gòu)已經(jīng)開(kāi)案，如委托方因故取消委托，則委托方同意支付給CCICT代付的全額規(guī)費(fèi)。委托方簽訂本報(bào)價(jià)單之后且CCICT已經(jīng)完成預(yù)測(cè)試，如果委托方因故取消委托，則委托同意支付給CCICT全額測(cè)試費(fèi)用。
5.7 The accessories/component used in the products targeted by this quotation must be certified for compliance with relevant local standards and/or regulations.This quotation is only for the product itself and does not include any accessories/component related certification or testing costs，Unless this quotation clearly stipulates the certification cost or testing cost for related accessories/component.
產(chǎn)品所使用的配件必須經(jīng)過(guò)相關(guān)法規(guī)的合規(guī)認(rèn)證，本報(bào)價(jià)單僅僅針對(duì)產(chǎn)品本體，不包含任何配件的相關(guān)認(rèn)證或者隨機(jī)檢測(cè)費(fèi)用, 除非本報(bào)價(jià)單有明確約定相關(guān)配件的認(rèn)證費(fèi)用或者隨機(jī)檢測(cè)費(fèi)用。
● INTELLECTUAL PROPERTY RIGHTS AND CONFIDENTIAL TERM知識(shí)產(chǎn)權(quán)和保密條款
6.1 All Intellectual Property Rights belonging to a party prior to entry into this Agreement shall remain vested in that
party. Nothing in this Agreement is intended to transfer any Intellectual Property Rights from either party to the other.
所有于簽署本協(xié)議之前歸屬于任何一方的知識(shí)產(chǎn)權(quán)仍應(yīng)歸該方所有。本協(xié)議無(wú)任何將任何一方的知識(shí)產(chǎn)權(quán)轉(zhuǎn)讓給
另一方的目的。
6.2 In the event of provision of certification services, Client agrees and acknowledges that the use of certification marks may be
subject to national and international laws and regulations.
在提供認(rèn)證服務(wù)的情況下，客戶同意并確認(rèn)：認(rèn)證標(biāo)志的使用可能受國(guó)家和國(guó)際法律法規(guī)的限制。
6.3 All Intellectual Property Rights in any Reports, document, graphs, charts, photographs or any other material (in whatever
medium) produced by CCICT pursuant to this Agreement shall belong to CCICT. The Client shall have the right to use any
such Reports, document, graphs, charts, photographs or other material for the purposes of this Agreement.
CCICT依據(jù)本協(xié)議所編制的任何工作報(bào)告、文件、圖解、圖表、照片或任何其它資料（無(wú)論載于何種媒介）中的
所有知識(shí)產(chǎn)權(quán)均歸CCICT所有?？蛻粲袡?quán)將任何該等工作報(bào)告、文件、圖解、圖表、照片或其它資料用于本協(xié)議
所載目的。
6.4 The Client agrees and acknowledges that CCICT retains any and all proprietary rights in concepts, ideas and inventions that
may arise during the preparation or provision of any Report (including any deliverables provided by CCICT to the Client)
and the provision of the Services to the Client.
客戶同意并確認(rèn)：CCICT在準(zhǔn)備或提供任何工作報(bào)告（包括CCICT向客戶提供的任何交付物）和向客戶提供服務(wù)
的過(guò)程中可能產(chǎn)生的概念、觀念和發(fā)明的任何和所有財(cái)產(chǎn)性權(quán)利都由CCICT保留。
6.5 CCICT shall observe all statutory provisions with regard to data protection. To the extent that CCICT processes or gets
access to personal data in connection with the Services or otherwise in connection with this Agreement, it shall take all
necessary technical and organizational measures to ensure the security of such data (and to guard against unauthorised or
unlawful processing, accidental loss, destruction or damage to such data).
CCICT應(yīng)遵守所有有關(guān)數(shù)據(jù)保護(hù)的法令法規(guī)。在處理或獲取與服務(wù)有關(guān)或與本協(xié)議有關(guān)的個(gè)人數(shù)據(jù)的范圍內(nèi)，
CCICT應(yīng)采取所有必要的技術(shù)和組織手段以保證這些數(shù)據(jù)的安全（并保護(hù)這些數(shù)據(jù)免受未經(jīng)授權(quán)的或非法的處理、
意外損失、破壞或損害）。
6.6 Where a party (the Receiving Party) obtains Confidential Information of the other party (the Disclosing Party) in
connection with this Agreement (whether before or after the date of this Agreement) it shall(1) keep that Confidential
Information confidential, by applying the standard of care that it uses for its own Confidential Information; (2)not disclose
that Confidential Information to any third party without the prior written consent of the Disclosing Party.
若任何一方（“接收方”）（不論是在本協(xié)議簽署日期之前或之后）獲得與本協(xié)議相關(guān)的另一方（“披露方”）的保
密信息，則應(yīng)：1）以保護(hù)自身保密信息相同的審慎方式來(lái)對(duì)保密信息進(jìn)行保密；2）未事先征得披露方書(shū)面同
意，不得向任何第三方披露保密信息。
6.7 The Receiving Party may disclose the Disclosing Party's Confidential Information on a "need to know" basis:(1)to any legal
advisers and statutory auditors that it has engaged for itself;(2)to any regulator having regulatory or supervisory authority
over its business;(3)where the Receiving Party is CCICT, to any of its subsidiaries, affiliates or subcontractors.
在“需要知道”的基礎(chǔ)上，接收方可將披露方的保密信息披露給以下人士或機(jī)構(gòu)：(1) 接收方聘請(qǐng)的任何律師顧問(wèn)及法定審計(jì)師；(2) 對(duì)接收方的業(yè)務(wù)擁有管制或監(jiān)管權(quán)力的任何監(jiān)管人；(3) 在CCICT是接收方的情況下，接收方的任何附屬機(jī)構(gòu)、關(guān)聯(lián)機(jī)構(gòu)或分包人。
● MISCELLANEOUS其他條款
7.1 Client hereby acknowledges that prior to its execution of this Agreement CCICT thoroughly explained each and every term
and condition under this Agreement to Client and each term and condition OF this Agreement has been thoroughly and
mutually consulted and negotiated between the two parties, AND THAT as such the terms and conditions under this
Agreement don't constitute an adhesive contract Imposed by either party but is reflection of the true MUTUAL assent of
both parties.
客戶特此聲明：簽署本協(xié)議前，CCICT已向其詳盡解釋本協(xié)議下每一條款或條件，本協(xié)議下每一條款或條件皆系
經(jīng)雙方充分協(xié)商和談判后達(dá)成，為此本協(xié)議下的條款和條件非任何一方單方提出的附和性條款或條件，而是反映
雙方真實(shí)合意的協(xié)議條款。
7.2 You cannot leak any information concerning this quotation in any form or make copy of this quotation without our
permission，Otherwise, the delinquent party shall bear all of the legal liability and our losses.
未經(jīng)我方同意，不得與第三方討論或以任何形式泄露本報(bào)價(jià)單任何內(nèi)容或復(fù)制本報(bào)價(jià)單，否則由違約方承擔(dān)相
應(yīng)法律責(zé)任和我方損失。
7.3 Any claim by the Client against CCICT (always subject to the provisions of this Clause 2 and Clause 6) must be made within ninety (90) days after the Client becomes aware of any circumstances giving rise to any such claim. Failure to give such notice of claimwithin ninety (90) days shall constitute a bar or irrevocable waiver to any claim, either directly or indirectly, in
contract, tort or otherwise in connection with the provision of Services under this Agreement.
客戶針對(duì)CCICT提出的任何索賠（須始終符合第2條和第6條規(guī)定）必須在其知悉任何引發(fā)該索賠之情形后的
九十（90）天內(nèi)提出，未能在該九十（90）天內(nèi)發(fā)出索賠通知即直接地或間接地排除對(duì)以違約、侵權(quán)或其它與本
